Terms and Conditions

1. General

  1. These Terms of Service, along with Virtuate Pty Ltd's ("Virtuate," "we," "us") applicable policies, govern the relationship between you and Virtuate in relation to your use of Pixadom, a game operated and managed by Virtuate Pty Ltd, as well as any related services, whether accessed via computer, mobile phone, or other devices. These policies are collectively referred to as the "Applicable Policies."
  2. By using or accessing the service, you agree to these terms. If you disagree, you are not permitted to use the service.
  3. Information regarding how we collect and process personal data can be found in our Privacy Policy.
  4. You agree that Virtuate may modify your device settings to optimize service usage.
  5. To use the service, you must first create an account.
  6. By registering or using the service, you confirm that you are 18 years of age or older.
  7. Virtuate's services may connect with third-party platforms (e.g., social media). Your activity on these platforms may be governed by their terms of service, and Virtuate is not responsible for third-party platforms or how they handle personal data.

2. License

  1. The Service includes various materials related to Virtuate Pty Ltd and its products, including text, images, software, designs, and intellectual property ("Content"). All Content is owned or licensed by Virtuate. You may not copy, redistribute, or exploit the Content without permission.
  2. Virtuate grants you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not grant ownership of any Content and can be revoked if the Terms are breached.
  3. Some Content may offer additional access under specific conditions.

3. Supporter Membership

  1. A Tier 1 supporter subscription does not grant access to the purchase of supporter-exclusive items from in-game shops.
  2. A valid and active supporter subscription is required to wear supporter-exclusive items, including but not limited to the custom headpiece (CHP).
  3. Ownership of CHPs remains with Pixadom. Accounts holding a CHP that remain inactive for more than six (6) consecutive months, or that have not maintained an active supporter membership for at least one (1) month within the past six (6) months, may have their CHP reclaimed by Pixadom at the discretion of its administration. In such cases, the original player retains access to their CHP, but the item may also be redistributed or sold to other players.
  4. The CHP is not the property of the player. Instead, it is a non-transferable, revocable license granted for exclusive use within Pixadom. This license remains valid unless the account is deemed abandoned, as outlined in Section 3. These terms are subject to change at the discretion of Pixadom's administration. By obtaining a CHP, you acknowledge and agree to these conditions.

4. In-Game Currencies and Goods

  1. The Service may include virtual currency ("Virtual Currency"), such as coins or gems, which can be bought with real money (gems) or earned in-game (coins). Virtual Currency can be used to purchase virtual items ("Virtual Goods"). Purchasing these grants a limited, non-transferable right to use them, but they remain the property of Virtuate Pty Ltd.
  2. Virtual Currency or Virtual Goods cannot be exchanged for real money or items of value outside the Service.
  3. All purchases of Virtual Currency or Virtual Goods are final and non-refundable unless otherwise stated.
  4. Virtuate Pty Ltd reserves the right to manage or modify Virtual Currency and Virtual Goods without liability.

5. Content Created by You, User-Generated Content

  1. You may submit content to the Service, including posts, reviews, feedback, and suggestions ("User-Generated Content").
  2. You retain ownership of your User-Generated Content but grant Virtuate Pty Ltd a non-exclusive, worldwide license to use, modify, and distribute it.
  3. You affirm that your User-Generated Content is original or that you have the necessary rights to grant this license to Virtuate Pty Ltd.
  4. We may monitor User-Generated Content, but we are not obligated to review everything.
  5. We reserve the right to edit or remove content that violates these Terms or applicable laws.
  6. If you encounter illegal or inappropriate content, please contact us.
  7. You are responsible for ensuring your content complies with relevant laws.
  8. You are solely responsible for interactions with other users, and Virtuate Pty Ltd is not liable for any disputes, though we may intervene.

6. Accounts

  1. Username and Password. During account creation, you will select a password ("Login Information"). You must not share this or let anyone else access your account. If you suspect any breach of security, such as unauthorized access, you must immediately notify Virtuate Pty Ltd and change your password. You are responsible for all activity under your account, including purchases.
  2. Virtuate Pty Ltd reserves the right to suspend or terminate accounts and reclaim usernames at any time without liability.

7. Suspension

  1. Virtuate Pty Ltd may suspend your access to the Service immediately or with prior warning if we believe you are violating these Terms, relevant laws, or any other Virtuate Pty Ltd policies. Suspension may occur after investigation or upon receiving a complaint about your behavior.

8. Use of the Service

  1. You may not use Virtuate's content outside the service unless explicitly permitted in writing. Retro or substitute sites offering gameplay with our content are prohibited.
  2. Virtuate Pty Ltd may limit your access to the service, in line with these Terms.
  3. When using the service, you must follow applicable laws and policies, including, but not limited to:
    • (i) No Children: You must be 18+ to access or use the service.
    • (ii) No False Information: You must not create accounts with false details.
    • (iii) No Content Manipulation: Do not manipulate or falsify content or legal notices.
    • (iv) No Re-access After Ban: If banned, you cannot access the service unless the ban is lifted.
    • (v) Respect Ownership of Others' Content: Do not use others' content without permission.
    • (vi) No Political Use: Your account is for non-political purposes only.
    • (vii) Limited Commercial Use: Except as allowed, the service cannot be used for commercial activity.
    • (viii) No Offensive or Illegal Content: Do not share harmful, unlawful, or defamatory content.
    • (ix) No Gambling: The service is for entertainment, not gambling. Violators may face suspension or legal reporting.
    • (x) No Harmful Software: Do not upload or share harmful software or viruses.
    • (xi) No Law Violations: You must not break or encourage the breaking of laws.
    • (xii) No Refusal to Cooperate: Follow instructions from Virtuate Pty Ltd personnel.
  4. Virtuate Pty Ltd reserves the right to determine and act against any conduct violating these terms, which could include account suspension or termination.

9. Third Parties

  1. The Service may include links to third-party websites, apps, or services. Virtuate Pty Ltd does not control or endorse these third-party links, content, or services and is not liable for any related issues. Your interactions with third-party content are subject to their own terms and policies.
  2. Third parties are responsible for ensuring their advertising or content complies with laws. Virtuate Pty Ltd disclaims liability for third-party material.
  3. Your interactions with third parties, including transactions, are solely between you and them. Virtuate Pty Ltd disclaims responsibility.
  4. Personalized campaigns within the Service comply with privacy policies and legislation.

10. Updates and Modifications to the Service

  1. You understand that the Service is continually evolving. Virtuate Pty Ltd may require you to accept updates to the Service or to third-party software on your device. You acknowledge that Virtuate Pty Ltd may modify or update the Service, and we will notify you of such changes. From time to time, you may need to update third-party software to continue using the Service.

11. Termination

  1. Virtuate Pty Ltd may suspend or terminate your account if you violate these Terms, fail to access your account for 180 days, or if the service is shut down. Suspensions result in temporary loss of access, and terminations are permanent, with no refunds provided for violations.
  2. Virtuate Pty Ltd may limit or terminate accounts if users create legal risks or violate intellectual property rights.
  3. You have six months to appeal suspensions or terminations.
  4. You may terminate your account anytime, but no refunds will be provided.
  5. Upon suspension or termination, all rights granted to you will cease immediately, though certain terms (like indemnities and legal provisions) will survive.
  6. Initiating a chargeback or payment dispute for any purchase related to Pixadom is considered a violation of these Terms of Service. If a chargeback is attempted, we reserve the right to suspend or restrict account access until the matter is resolved. If a chargeback is successful, the associated account will be permanently banned and terminated, with no possibility of reinstatement and regardless of the chargeback amount. Before filing a chargeback, users must first attempt to resolve the issue by contacting us directly. We are open to discussing and negotiating a resolution, but initiating a chargeback without prior communication may result in the loss of access to Pixadom and its related services.

12. Disclaimer of Warranties; Limitation of Liability; Sole and Exclusive Remedy; Indemnification

  1. Disclaimer of Warranties. Your use of the Service is at your own risk. The Service is provided "as is" without warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Virtuate Pty Ltd makes no guarantees regarding the Service's functionality, availability, security, or error-free operation.
  2. Limitation of Liability; Sole and Exclusive Remedy. Virtuate Pty Ltd is not liable for direct, indirect, incidental, or consequential damages related to your use of the Service. In any case, the maximum liability is limited to the amount you've paid to Virtuate Pty Ltd in the past six months or 500 AUD, whichever is lower.
  3. Jurisdictional Limitations. Some jurisdictions may not allow certain disclaimers or limitations. In such cases, Virtuate Pty Ltd's liability is limited to the minimum allowed by law.
  4. Indemnity. You agree to indemnify Virtuate Pty Ltd from any claims, losses, or damages (including legal fees) arising from your use of the Service or violation of these Terms.

13. Dispute Resolution, Governing Laws, Agreement to Arbitrate on an Individual Basis, and Time to File Claims

  1. Please read carefully as this section outlines the need to resolve disputes through arbitration on an individual basis between you and Virtuate Pty Ltd.
  2. By agreeing to these Terms, you and Virtuate Pty Ltd agree to resolve all disputes or claims related to the Terms, the Service, or our relationship through arbitration. Collective or group actions are not permitted.
  3. Country of Residence refers to your primary country of citizenship or legal residence and determines how disputes are resolved.

14. Governing Law

  1. Governing Law. For users in the United States, these Terms are governed by Australian law. For users outside the U.S., these Terms and the arbitration agreement are governed by Australian law, regardless of conflict-of-law principles.
  2. Informal Dispute Resolution: Before filing a formal claim, you agree to attempt to resolve disputes by contacting Virtuate Pty Ltd directly.
  3. Agreement to Arbitrate: By accepting these Terms, you agree to resolve disputes via final and binding arbitration, except as noted under "Exceptions."
  4. Opt-out of Arbitration: You may opt-out of arbitration by contacting Virtuate Pty Ltd within 30 days of accepting these Terms.
  5. Arbitration Procedures and Fees: Arbitration is administered by the Arbitration Institute of Australia and may be conducted in English and in Australia or remotely.
  6. Individual Arbitration: All disputes must be handled individually, not as part of a class or collective action.
  7. Class Action and Collective Arbitration Waiver: To the maximum extent permitted by law, class or collective actions are waived.
  8. Exceptions to Arbitration: Legal actions may be taken for temporary injunctive relief, and small claims processes may apply in certain jurisdictions, including the U.K. and European Economic Area.
  9. Judicial Forum for Disputes: If arbitration does not apply, legal claims must be filed in a competent court in Australia.
  10. Time to File Claims: All claims must be filed within one year of the dispute's discovery, or they are barred.

15. Severability

  1. If any part of these Terms or related policies is found to be illegal or unenforceable by a court, that portion will be considered ineffective only in that jurisdiction and to the extent necessary, without affecting the enforceability of the remaining provisions. The rest of the Terms will remain in full force and effect.

16. Linking to Our Service

  1. Virtuate Pty Ltd grants you a limited, non-exclusive, revocable license to create hyperlinks to the Service, provided: (a) the links only use text, not trademarks; (b) the links do not imply affiliation with Virtuate Pty Ltd or cause confusion; and (c) the links do not present the Service in a misleading or offensive manner. Virtuate Pty Ltd reserves the right to prohibit or suspend linking without prior notice.

17. General Provisions

  1. Assignment: Virtuate Pty Ltd may assign these Terms without your consent. You may not assign any rights without our prior written consent.
  2. Entire Agreement: These Terms, along with any applicable policies, constitute the entire agreement between you and Virtuate Pty Ltd.
  3. No Waiver: Failure to enforce any provision doesn't waive our right to enforce it later.
  4. Updates to Terms: We may modify these Terms as needed. Continued use constitutes acceptance of new Terms.
  5. Notices: Notices must be addressed to Virtuate Pty Ltd.
  6. Customer Service: Support is provided at our discretion.
  7. Equitable Remedies: Virtuate Pty Ltd may seek injunctive relief for any breach of these Terms.
  8. Copyright Infringement: Contact customer service for copyright issues.
  9. Force Majeure: We are not liable for delays caused by factors beyond our control.
